ABD ve Japonya'dan Sonra Tayvan da AB'den Şikayetçi

Amerika Birleşik Devletleri ve Japonya'nın ardından Tayvan da Avrupa Birliği ile Birlik'in belirli teknoloji ürünlerine uyguladığı tarifelere ilişkin olarak Dünya Ticaret Örgütü ihtilafların halli mekanizması dahilinde istişarelerde bulunmayı talep etti (http://antidamping.blogspot.com/2008/06/abd-ticaret-temsilcisi-teknoloji.html). Konuyla ilgili açıklama Tayvan Uluslararası Radyosu tarafından 13 Haziran 2008 Cuma günü yapıldı.

Avrupa Komisyonu Ticaret Genel Müdürlüğü çoklutaraflı bir düzenleme olan Enformasyon Teknolojisi Anlaşması'nı ihlal ettiklerine ilişkin iddiaları kesin bir dille reddetmişti. Dünya Ticaret Örgütü kurallarına göre taraflar 60 gün içerisinde bir uzlaşmaya varamazsa panel kurulmasını talep edebilecek.

Konuya ilişkin açıklama Resmi Gazete'de yayımlandı

ANKARA - Malezya menşeli split kilamalara damping vergisi gelirken, ABD ve Kanada menşeli yönlendirilmiş lif levhalar için de damping soruşturması açıldı.

Dış Ticaret Müsteşarlığı'nın (DTM) Resmi Gazete'nin bugünkü sayısında yayımlanan ve 10 gün sonra yürürlüğe girecek İthalatta Haksız Rekabetin Önlenmesine İlişkin Tebliği'ne göre, Arçelik-LG Klima San. ve Tic. A.Ş, Çin menşeli "yalnız duvar tipi split klimalar", "Yalnız duvar tipi klimaların dış ünitesi (değişken soğutucu debili split klima sistemleri dış ünitesi hariç) ile "Yalnız duvar tipi split klimaların iç ünitesi" tanımlı eşyaya yüzde 25 oranında dampinge karşı vergi konulmasının ardından, söz konusu eşyanın menşe yanıltması yapılarak Malezya üzerinden Türkiye'ye ihraç edildiği iddiasıyla DTM'ye başvuruda bulundu. Bu başvuruya Vestel Beyaz Eşya Sanayi ve Ticaret A.Ş de destek verdi.

Soruşturma sürecinde Panasonic Air Conditioning, Manufacturing Sdn. Bhd.Malezya ve Hitachi Air-Conditioning Products unvanlı firmalar işbirliğinde bulunurken, Malezya'dan Türkiye'ye ihracatın çok büyük kısmını gerçekleştiren diğer üretici ve ihracatçı firmalar ise işbirliğine yanaşmadı.

Soruşturma sonucunda, Malezya menşeli olarak beyan edilen veya bu ülke çıkışlı söz konusu ürünün ithalatında da, Çin'le aynı oranda dampinge karşı vergi ve teminat şeklindeki geçici önlem kararı alındı.

Ancak, yalnız duvar tipi split kilamada ve klimanın dış ünitesindeki teminat oranı Panasonic, Manufacturing ve Hitachi için sıfır olarak belirlendi. Bu oranın, yalnız duvar tipi split klimaların iç ünitesi tanımlı eşyada diğer üretici firmalar için yüzde 25 olarak uygulanması öngörüldü.

DTM'nin geçici önlemi 6 ay süreyle yürürlükte kalacak.

Lif levhalara soruşturma

DTM'nin bir başka İthalatta Haksız Rekabetin Önlenmesi Tebliğine göre de, yerli üretici Sumaş Suni Tahta ve Mobilya Sanayi A.Ş, ABD ve Kanadalı menşeli "yönlendirilmiş lif levhalar"ın Türkiye'ye dampingli fiyatla ithal edildiği ve yerli üretime zarar verdiği iddiasıyla önlem alınması istemiyle başvuruda bulundu. Yapılan inceleme sonucunda, ABD ve Kanada menşeli söz konusu ürün için İthalatta Haksız Rekabeti Değerlendirme Kurulu'nca soruşturma açılmasına karar verildi.

Damping önlemlerinin yürürlük süresi

İthalatta Haksız Rekabetin Önlenmesine Dair bir başka Tebliğ ile de, bazı ürünlerdeki dampinge karşı önlemlerin sona ereceği tarihler belirlendi.

Tebliğde yer alan ürünler ile dampinge karşı önlemlerin yürürlükten kalkma tarihleri şöyle:

Tebliğe göre, önlemlerin yürürlük sürelerinin bitiminden önce ilgili kişi ya da kuruluşların, önlemin sona ermesinin dampingin ve zararın devam etmesine yol açacağı iddiasıyla, nihai gözden geçirme soruşturması açılmasını talep etme hakkı bulunuyor.

İthalatta Gözetim Uygulanmasına İlişkin Tebliğ'de değişiklik

Bu arada, DTM'nin İthalatta Gözetim Uygulanmasına İlişkin 2005/4 sayılı Tebliğinde de değişikliğe gidildi. Bu çerçevede, "36.04 şenlik, işaret ve yağmur fişekleri ile sis işaretleri ve diğer pirotekni eşyası"yla ilgili gözetim uygulamasında daha önce ton başına 8 bin dolar olan CİF kıymeti, 20 bin dolar olarak yeniden düzenlendi.

Abstract


This paper reviews the WTO Appellate Body Report on United States – Anti-Dumping Measures on Oil Country Tubular Goods (OCTG) from Mexico (WT/DS282/AB/R 2 November 2005). This dispute concerns the disciplines imposed by the Anti-Dumping Agreement on WTO Members seeking to extend their anti-dumping measures beyond the original five-year period through a so-called sunset review. Our analysis focuses on the Appellate Body's finding in this case that no causation analysis is required in sunset reviews, and addresses the AB's approach towards the legal instrument that provides for the US policy in terms of sunset reviews, the Sunset Policy Bulletin. We conclude that the Anti-Dumping Agreement, as interpreted by the Appellate Body in this and other similar cases, imposes only minimal disciplines of a general nature on Members wishing to extend the anti-dumping measure beyond its original five-year period. We argue that the ‘textual’ argument relied on to support this deferential approach is weak and has resulted in undermining the practical effect of, what was considered to be, one of the major achievements of the Uruguay Round Anti-Dumping Agreement: limiting the life span of an anti-dumping measure to five years. From an economic perspective, Panels and the Appellate Body are simply debating the wrong type of questions. The prospective nature required by a sunset review analysis raises questions such as why exporters engaged in dumping in the first place, and what the conditions of the industry were so that the dumped imports caused injury. At the moment, sunset reviews seem adrift as panels and the Appellate Body fail to give guidance to Members on how to do a more economically sound and informed review.

Abstract

We review the WTO Appellate Body report on United States – Sunset Reviews of Anti-Dumping Measures on Oil Country Tubular Goods from Argentina (WT/DS268/AB/R, 29 November 2004). This dispute is one of several that deals with sunset reviews of antidumping-duty orders. In its ruling, the AB reasserts a rigid distinction between mandatory and discretionary law, and sets a very high standard for Member challenges to laws or practices that allow for violations of WTO obligations but do not mandate such behavior. We argue that this ruling is unfortunate, because it diminishes scope of and incentives for ‘as-such’ challenges to laws and practices, which have a potentially useful role to play in the world trading system. The AB ruling also overlooks the purpose and objectives of sunset reviews – to ensure that duty orders are not extended when their removal would generate no harm to an import competing industry – by failing to impose sufficient discipline on their conduct. We argue that a sunset review requires an evaluation of competitive conditions in the industry and of the reasons and incentives for dumping, in order that the investigating authority can judge whether the removal of a duty order would lead to a continuation or recurrence of dumping and injury. The Appellate Body's rulings in this and other similar cases have the effect of relieving the investigating authority of this responsibility and thereby render the sunset review process virtually meaningless.

Abstract

This paper addresses the issues that came before the Appellate Body in the Softwood V dispute, concerning an affirmative antidumping determination by the US Department of Commerce. The paper addresses both the original Appellate Body opinion in the dispute, and the later opinion reviewing the compliance panel findings. We focus primarily on the ‘zeroing’ issue in ‘transaction-to-transaction (T–T)’ calculations of dumping, and briefly on two other cost-allocation issues. In general, we are ambivalent about the Appellate Body's approach to the zeroing issue. On the one hand, zeroing inflates dumping margins without any sound economic rationale for doing so. On the other hand, zeroing has been a standard administrative practice for many years and the ADA does not clearly prohibit it. The Appellate Body's legal analysis of the matter in T–T cases, in particular, rests on shaky premises. We also consider the wisdom of addressing the zeroing issue in piecemeal fashion through what has proven to be a lengthy sequence of narrow decisions.

Antidumping laws have existed in some form since the early twentieth century. Ostensibly aimed at protecting domestic producers from unfair trade practices, they have sometimes been used as weapons of protectionism even when dumping has not occurred. When this happens, some special interest group gains at the expense of the general public. This paper begins with a review of the theory and practice of antidumping laws, then proceeds to examine recent trends in antidumping cases involving four Asian countries and regions.

Abstract


While the WTO Member countries continue to increase their FTA arrangements with divergent frameworks, they have begun to adopt modified WTO trade remedy systems in FTAs. Although the content and degree of these modified systems may not be significant yet, they still set very important precedents, or ‘seeds’, for ‘rule diversification’ in the world trading system. Such modification typically aims to further liberalize mutual trade between FTA parties and thereby contribute to a freer world trading system. However, such rule diversification appears to be inconsistent with the mandate of Article XXIV of GATT by worsening economically inferior trade diversion. The reinterpretation of the legal obligations in Article XXIV commensurate with economically more reasonable structures implies that trade remedy rules in FTAs should be applied on a non-discriminatory basis. Moreover, an FTA safeguard measure must precede a WTO safeguard measure to ensure optimal competitive conditions among trading partners. In sum, the right channel for improving the current WTO trade remedy systems is not the FTA forums but the WTO negotiation.
